Terms of Service

1. General

These terms of service apply to the use of the Thumbs Up app (“the App”), offered by Javelin Marketing, located at J.C. Kapteynlaan 52, 9714CT Groningen, registered with the Chamber of Commerce under number 54506808.

By downloading, installing, or using the App, you agree to these terms.

2. Description of the service

Thumbs Up is a check-in app for people who live alone. The App allows users to check in regularly to indicate that they are doing well. If a user does not check in within the set deadline, their designated contacts are alerted.

3. Important liability limitation

Thumbs Up is a reminder tool and explicitly NOT an emergency service, medical alarm system, or life-saving system.

The App is designed as a convenient tool, but:

• We do not guarantee that notifications will always be delivered on time. Push notifications and emails depend on external services (Apple, Google, internet connection) that are beyond our control.
• We are not responsible for missed notifications, technical failures, or situations where the App does not function as expected.
• The App does not replace professional care, medical monitoring, or emergency services.
• We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of or inability to use the App.

In case of emergency, always call your local emergency number.

4. User responsibilities

As a user, you are responsible for:

• Entering correct and up-to-date contact details for your contacts.
• Checking in on time within the deadlines you have set.
• Maintaining a working internet connection and enabling notifications on your device.
• Informing your contacts that they have been designated as emergency contacts.
• Not misusing the App for unwanted or illegal purposes.

5. Prohibited use

It is not permitted to:

• Use the App for spam, intimidation, or stalking.
• Provide false or misleading information.
• Attempt to hack, reverse-engineer, or otherwise manipulate the App or its underlying systems.
• Use the App in a manner that violates applicable law.

6. Intellectual property

All rights to the App, including but not limited to source code, design, texts, and images, belong to Javelin Marketing. It is not permitted to copy, modify, or distribute any part of the App without prior written permission.

7. Availability

We strive to keep the App available but do not guarantee uninterrupted operation. The App may be temporarily unavailable due to maintenance, updates, or technical failures. We are not liable for any damages resulting from unavailability.

8. Termination

We reserve the right to restrict or terminate your access to the App if you violate these terms. You can stop using the App at any time by removing it from your device.

9. Changes

We may change these terms from time to time. In case of significant changes, we will notify you through the App. Continued use of the App after changes constitutes acceptance of the modified terms.

10. Applicable law

These terms are governed by Dutch law. Any disputes will be submitted to the competent court in Groningen, the Netherlands.
